General conditions
These terms of use («Terms of Use») are a legal agreement between you and StepUp (hereinafter referred to as «StepUp», «we» or «our» as the context requires) for your use of the StepUp App. These Terms of Use set out important information about your rights and obligations in connection with the StepUp App. Please read them carefully. By downloading, installing or using the StepUp App, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, please do not download, install or use the StepUp App. StepUp allows you to use the StepUp App only in accordance with these Terms of Use. PyrosAppAndGames retains ownership of the StepUp app. These Terms of Use apply to your use of any updates or changes to the StepUp App that we may post from time to time.
The license granted to you for the use of the StepUp application
StepUp grants you a non-exclusive, non-transferable, revocable license to do the following in accordance with these Terms of Use (the «License»): Download, install and use the StepUp Application, and any updates provided by StepUp from time to time, in object code form for your personal use only on a compatible mobile device owned or controlled by you. The licenses granted under these Terms of Use may be terminated by StepUp at any time in its sole discretion, with or without notice. If you breach any provision of these Terms of Use, that license will automatically terminate. Upon termination of the license, you agree to stop using the StepUp Application and to delete any copies of the StepUp Application that you may have.
No medical advice
The StepUp app allows you to track and verify your physical movement, generate steps, and use points to redeem goods, services, and other benefits. THE SERVICES WE PROVIDE DO NOT CONTAIN OR CONSTITUTE, AND SHOULD NOT BE CONSTRUED AS, ANY FORM OF MEDICAL ADVICE OR OPINION. We are not licensed medical professionals, and we are not in the business of providing medical advice. You should always consult a qualified and licensed medical professional before beginning or modifying any diet or exercise program. The StepUp app is not a tool for the diagnosis or prevention of disease. We do not endorse any third party products or services, you should always consult a doctor before using them.
Rights to the StepUp application and its content
All intellectual property rights and other rights in or to the StepUp App, and any Content, made available by or on behalf of StepUp and its licensors, belong to and remain at all times with StepUp and its licensors. Except as expressly provided in these Terms of Use. The StepUp App is licensed and not sold under these Terms of Use. The only rights granted to you in connection with the StepUp Application under these Terms of Use are the License described in these Terms of Use and any transfer of ownership or right to access or use any source code related to the StepUp Application. Using the StepUp App
To use the StepUp app, you must create a user account. You are responsible for all uses of your StepUp Account, whether by you or by a third party. You must ensure that you use your personal email to verify your account and a strong password (if applicable) for your StepUp account and that your password details are kept confidential and secure at all times. To the fullest extent permitted by applicable law, we will not be liable to you for any unauthorized use of your StepUp Account as a result of your failure to restrict access to your mobile device or email, the confidentiality or security of your user data. or not using a strong password. Your StepUp account records the details of all steps generated by you and any StepUp transfers to or from your StepUp account. Check your StepUp account regularly. Different levels of membership may apply to the StepUp Accounts of different users, and depending on the level of membership you have, your right to access the functionality of the StepUp App or generate steps may vary.
Coins
Coins are units of exchange that users of the StepUp App can generate through verified physical movement (eg, steps) upon viewing an ad. The coins can be used to exchange products, services and other benefits through the StepUp application, to the extent that said products, services and other benefits are offered, coins cannot be exchanged for physical money, unless an amount is established for coin into a specific prize. All points are generated by verified physical movement of StepUp app users. Coins will never be generated by any other means. We reserve the right to destroy coins that we have reason to believe have been created by any other means and to suspend or disable StepUp Accounts used in violation of these Terms of Use. We may limit the maximum number of coins that StepUp App users can generate each day using the StepUp App. The applicable limit may vary based on the relevant user’s membership level or other criteria we choose to apply and we may modify such limits from time to time.
Acceptable use
You agree that you shall not: Attempt to generate steps by any means other than your genuine physical movement that meets the eligibility criteria specified by StepUp from time to time and, in particular and without limitation, you shall not simulate any such verified movement using artificial devices and/or or o mechanical means, recruit third parties to generate steps on your behalf. Copy, adapt, transmit, reverse engineer, decompile, disassemble, modify, sell the StepUp App or any content accessible on any of them, except as expressly permitted by these Terms of Use or applicable law; Use the StepUp App in an unlawful manner, for any illegal purpose or in any manner that is inconsistent with these Terms of Use, or act in a fraudulent or malicious manner, for example, by hacking or inserting malicious code, including viruses or harmful data, into the StepUp app. Infringe our intellectual property rights or those of any third party in connection with your use of the StepUp App. Transmit any material that is defamatory, explicit, offensive or objectionable in the StepUp application Use the StepUp App in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; Employ any technology that interferes in any way with the proper working of the StepUp Application, including blocking any advertisements or promotions displayed on them. Harvest or collect any information or data from the Step App for any commercial purpose, except as otherwise agreed by us in writing. Claiming offers that are not in your country, for example, you cannot claim a Spanish offer if you have an address in Italy. You are prohibited from using points in one country to purchase offers in a different country. If we discover any breach by you, we may immediately suspend or terminate your access to the StepUp App and remove any content from the StepUp App that violates the StepUp App.
Changes and updates to the StepUp app
StepUp reserves the right at any time, without liability of any kind, in its sole discretion to change, suspend, restrict or disable your access to the StepUp App, and/or alter the functionality or content of the StepUp App with or without notice. We may issue updates to the StepUp app from time to time. Depending on the nature of the update, you may not be able to continue using the StepUp app until you have downloaded the latest version of the StepUp app.

The StepUp App is provided «as is» and «as available» without any representation, warranty or commitment of any kind as to the availability, performance, accuracy or completeness of the StepUp App. TO THE MAXIMUM EXTENT POSSIBLE UNDER APPLICABLE LAW, NO WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR NON-INFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS MADE IN CONNECTION WITH WITH StepUp APP. IF THIS EXCLUSION DOES NOT APPLY UNDER APPLICABLE LAW.
Third Party Content
As a convenience to you, StepUp may include in the Application links to other sites on the Internet that are owned or operated by third parties («Third Party Websites»). You also agree that StepUp has no control over the content of Third Party Websites and has no responsibility for any material available on such Third Party Websites or for any use of or reliance on the contents of such Third Party Websites by you. The StepUp application may include content submitted by other users. You acknowledge that any use of or reliance on such Content by you is at your own risk and we are not responsible for such Third Party Content. The fact that we may link to a third party website or display third party content does not imply that we endorse the site or the products or services on such third party website or have reviewed, approved or verified the third party content.
User age restrictions
The StepUp app is not intended for children under the age of 13. If you are under the age of 13, you should not use the StepUp App. If we discover that such use is taking place, we will immediately terminate any relevant user account facilitating such use. If you are under the age of 16, you must have obtained the consent of your parent or legal guardian to use the StepUp App.
Limitation of Liability
You acknowledge that the StepUp App has not been developed to meet your individual requirements and that it is therefore your responsibility to ensure that the StepUp App’s facilities and functions meet your requirements. To the maximum extent permitted by applicable law, we have no liability, whether in contract, tort (including negligence) or otherwise, for any loss of profit, loss of business, business interruption or loss of business opportunity , arising out of or in connection with the StepUp App, loss, damage or other liability arising from the unavailability or malfunction or other deprivation of access to the StepUp App or any inaccurate or incomplete content in any or any loss.
